Terms of Use — Witram LëtzDrill
These terms are a contract between you and Witram Tech S.à r.l.-S ("Witram", "we", "us"), [REGISTERED ADDRESS], RCS Luxembourg [RCS NUMBER], VAT [VAT NUMBER], support@witram.lu. Please read them before using the Witram LëtzDrill app ("the app").
1. The app
1.1 Witram LëtzDrill is an iOS app (iPhone and iPad, iOS 17 or later) for learning Luxembourgish and preparing for the Sproochentest, the Luxembourgish language test for Luxembourg nationality.
1.2 Independence. The app is independent. It is not affiliated with, approved or endorsed by the Institut national des langues Luxembourg (INLL), the Ministry of Education (MENJE), the Zenter fir d'Lëtzebuerger Sprooch (ZLS), France Éducation international or the Goethe-Institut. Exam names (such as Sproochentest, DELF or Goethe-Zertifikat) are used only to describe what the app helps you prepare for.
1.3 Readiness estimates in the app (pace checks, mock exam scores, predicted readiness) are our own estimates to guide your study. They are not an official assessment and do not predict or guarantee an official result, except as set out in the Pass-or-extend guarantee (section 7).
2. Who can use the app
2.1 You must be 18 or older. You confirm this during onboarding.
2.2 You need an account, created with Sign in with Apple, Google sign-in, or email and password. Keep your login secure; you are responsible for activity under your account.
2.3 Our Privacy Policy explains how we handle your data: https://letzdrill.witram.lu/legal/privacy.
3. Relationship with Apple
3.1 These terms are between you and Witram only, not Apple. Witram, not Apple, is solely responsible for the app and its content.
3.2 Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
3.3 Apple is not responsible for addressing any claims by you or third parties relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or intellectual property infringement claims. Witram handles such claims.
3.4 You confirm that you are not located in a country subject to a U.S. government embargo or designated as "terrorist supporting", and are not on any U.S. government list of prohibited or restricted parties.
3.5 Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
3.6 Your use of the App Store is also governed by Apple's Media Services Terms. Where these terms conflict with Apple's Licensed Application End User License Agreement on a point Apple requires, Apple's minimum terms apply.
4. Products and prices
All purchases are made through Apple In-App Purchase. Prices include VAT and are shown in the App Store before you buy.

4.2 Plus subscriptions renew automatically at the end of each period and are charged to your Apple ID unless you cancel at least 24 hours before the period ends. Manage or cancel in your Apple ID settings (Settings → [your name] → Subscriptions).
4.3 Free trial. The 7-day free trial is available on the yearly plan only, once per Apple ID. You will be charged €59.99 when the trial ends unless you cancel at least 24 hours before it ends.
4.4 Fair use. AI features (Pass and Plus only, including during a Plus free trial) are subject to reasonable fair-use limits shown in the app, to protect the service and its costs.
4.5 We may change prices for future periods. Apple notifies subscribers of price increases as required by its rules, and you can cancel before they apply.
5. Withdrawal right and refunds
5.1 The app supplies digital content and services immediately after purchase. When you buy, you expressly agree to immediate supply and acknowledge that you lose your 14-day right of withdrawal once supply begins (Consumer Rights Directive 2011/83/EU, Art. 16(m); Luxembourg Consumer Code). Apple's terms govern the purchase process.
5.2 Refunds are handled by Apple only, through reportaproblem.apple.com. We cannot issue refunds directly.
5.3 Nothing in these terms limits your statutory consumer rights, including your rights if digital content is not supplied or does not conform to the contract.
6. Licence to use the app
6.1 We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, as permitted by Apple's Usage Rules, for your own non-commercial learning.
6.2 You may not: copy, extract or redistribute the app's content (lessons, audio, exercises, mock exams); reverse-engineer the app except as allowed by law; circumvent purchases, App Check or usage limits; use automated means (bots, scrapers) to access our servers; share your account; or use the app to break the law.
6.3 Your content. You keep any rights in the answers and recordings you submit. You allow us to process them only to provide the service (for example, grading). We do not publish them.
7. Pass-or-extend guarantee
7.1 What it is. If you meet all eligibility conditions below and do not pass the Sproochentest, we give you free Pass extensions so you can keep preparing for your re-sit.
7.2 Eligibility. During your Sproochentest Pass period you must:
- (a) complete all 52 curriculum days;
- (b) complete at least 2 full mock exams in the app;
- (c) be "on pace" by your exam date according to the in-app pace check (meeting the target for new words started); and
- (d) sit the Sproochentest within the Pass period or within 30 days after it ends.
The app records (a)–(c) automatically; the in-app guarantee status shows whether you qualify. The in-app status is for information; claims are decided under these terms.
7.2a How we read these conditions. Where a condition could be read more than one way, we read it in your favour:
- "Full mock exam" (b). A mock exam counts as full when you completed every part the app could offer you. If the app skipped the listening part because not enough approved recordings were available yet, that mock still counts as a full mock exam. A part you chose to skip does not.
- "During your Pass period" (b). Your Pass period starts on the purchase date of the Pass that opened your current Pass window, as recorded on our servers from Apple's signed purchase records (extensions bought before your Pass ends continue the same window). Mocks completed at any time on that calendar day or later count. If our servers do not have the date, we use the purchase date your device reports. If neither date is available, every mock you have completed counts. A missing date is never held against you.
- "On pace" (c). The pace check's "on track" and "tight" (just on pace) states both count as on pace. "Behind" does not.
- "By your exam date" — status fixed on your exam date. Conditions (a)–(c) are assessed as they stood at the end of your exam day (midnight, Luxembourg time): mocks completed and words started up to that moment count, and the pace check is the one for your exam day. Where the app cannot tell when something was done (for example when a curriculum day was completed), it uses your progress at the time it first records the status, which can only help you. Once your exam day has ended, the in-app status shows "Status as of your exam on [date]" and is fixed: practice after the exam, or no practice, and the passing of time never change a condition that was met into one that is not met. If you change your exam date after it has passed, the status for the original date stays visible and the new date is assessed on its own. If you never set an exam date, there is nothing to fix and the status shows your current progress. The fixed status is stored with your account on our servers (not only on your device), so it is the same on a new or reinstalled device; it is included when you export your data and deleted when you delete your account.
Counsel note: these readings implement owner decisions D-APP-66, D-APP-74 and D-APP-77 (and D-BE-50 for the server date, D-BE-59 for the stored status). Once the account is deleted the stored status is gone, so a later claim can only rely on what the learner provides — please confirm this is acceptable. Please confirm the wording works as part of a commercial guarantee under the Consumer Code (see question 3 below) and whether these readings also need to appear in the App Store description.
7.3 How to claim. Email support@witram.lu with proof of your result (the official result notice) within 30 days of receiving it. You may redact personal details not needed to confirm the date and outcome.
7.4 Remedy. We grant free Pass extensions in 30-day blocks until your next re-sit date, for up to 2 re-sits within 12 months after your original exam date. Extensions are added to your account; they are not App Store purchases.
7.5 No cash refund. The guarantee provides extended access only. It does not provide any cash refund. Refunds are available only through Apple's refund process (section 5.2).
7.6 Statutory rights unaffected. The guarantee is a voluntary commercial guarantee in addition to your legal rights, which it does not restrict.
7.7 The guarantee applies to the Sproochentest Pass only, not to Plus subscriptions or the free tier, and cannot be transferred. We may refuse claims involving fraud or manipulated progress data.
8. Content and sources
8.1 Dictionary data comes from LOD.lu (Lëtzebuerger Online Dictionnaire, published by the ZLS) under the CC0 1.0 public domain dedication. We use text only; no ZLS audio is used.
8.2 All audio in the app is recorded in-house by Witram and its voice contributors.
8.3 All other content, design, code and trademarks (including "Witram" and "LëtzDrill") belong to Witram Tech S.à r.l.-S or its licensors.
8.4 Content is carefully prepared and reviewed but may contain errors. Please report errors to support@witram.lu.
9. AI features
9.1 Optional AI features (speaking and interview grading, writing feedback, mistake explanations, mnemonics, example sentences) use Google Gemini. They are used only after your explicit consent and can be turned off in Settings. See our AI Disclosure: https://letzdrill.witram.lu/legal/ai.
9.2 AI output is labelled as AI-generated and can be wrong. AI grades are practice feedback, not official scores. Do not rely on them as the sole basis for decisions about your exam.
10. Availability and changes
10.1 We aim to keep the app available but cannot guarantee uninterrupted service. Some features need an internet connection.
10.2 We may update the app to fix bugs, improve it or comply with law. We will not remove core features of a paid product during a paid period in a way that significantly harms you without notice and, where required by law, a remedy.
11. Liability
11.1 We are liable without limitation for death or personal injury caused by our negligence, for intentional misconduct and gross negligence, and wherever liability cannot be limited by Luxembourg law.
11.2 Otherwise, for ordinary negligence we are liable only for foreseeable damage typical for this kind of contract, and our total liability is limited to the amount you paid us in the 12 months before the claim.
11.3 We are not responsible for official exam outcomes, decisions by authorities, or the content of third-party services (Apple, Google).
11.4 Nothing in this section limits your mandatory consumer rights, including your rights for non-conforming digital content.
12. Suspension and termination
12.1 You can stop using the app and delete your account at any time (Settings → Delete account). Deleting your account does not cancel an Apple subscription.
12.2 We may suspend or close accounts that seriously or repeatedly breach these terms (for example, fraud or abuse of our servers), after notice where reasonable.
13. Changes to these terms
We may update these terms. We will inform you in the app of material changes in advance. If you do not agree, you may stop using the app and cancel your subscription; changes do not apply retroactively to periods already paid.
14. Governing law, courts and disputes
14.1 These terms are governed by Luxembourg law. If you are a consumer living in another EU country, you keep the protection of the mandatory consumer law of your country of residence.
14.2 Consumers may bring proceedings in the courts of Luxembourg or of their place of residence; we may only sue consumers in the courts of their residence.
14.3 Please contact support@witram.lu first; we will try to resolve any problem. You may also use the Luxembourg consumer mediation service (Service national du Médiateur de la consommation). The EU Online Dispute Resolution platform [CONFIRM STATUS — the ODR platform was scheduled to close in July 2025].
